Are you sure that Take2 owns the *code*? I was left with the impression that Take2 got essentially everything but that (and the team, of course). (I suppose that leaves them free to do Oni 2 with a fresh code base, but they'd probably appreciate at least a running (or dashing ;-) head start, to save them a few months of development time.)

I'm fairly sure that Microsoft was going to be in charge of any bug fixes or patches, though I suppose that could simply have been a matter of expediency (rather than delaying any critical post-release show stoppers for 6 months while another development group in Take 2's stable learns the code base). (On the other hand, with the Bungie West team now off doing "Visual Basic: The Musical" or whatever their next project is, I wonder how prompt any fixes from Microsoft would be in any case.)

However, you are definitely correct that Take 2 doesn't actually *need* Microsoft for Oni 2; if they didn't get the code, though, I hope that doesn't make the difference between Oni 2 being practical and not.
