OK... is there some point you're trying to make? What I said still applies:
You could say it's modded given the stuff it has that nothing else does, but I'm confident 343i did that (even if they were copying someone else), and it's officially provided, so by Microsoft's standards it's not modded, which is the important factor here.
I don't have a moral problem with modded stuff. It wasn't being run at Customs Night because MS could (easily) hand out bans for having it in file shares or even for playing it, regardless of how likely or unlikely it might have been. For this particular gametype, that chance is (now) zero, so it will be run. That's easy enough to understand, right? (That's not a dig at you, I want to make sure I'm explaining it well.)
Regardless of your thoughts on it, Race is now in matchmaking, and as soon as someone wants to play it, it'll be in Customs Night too, and IMHO this is a good and exciting thing.
