Well, if they are still humans, they have some free will. To make them undead and unfaltering servants, their souls need to be..."extracted". I think stolen doesn't mean like, Balor took them while they weren't looking, just like taken from them.

I think this refers to the fact that as their health increases they regain their motive power. Now obviously their health doesn't regenerate ingame but over time I'm sure they'd heal and the result would be similar to that of a mandrake root on them, except slower.
