It never clearly says WHEN he dies in the Sword Age. He might already be dead at the start of the game.

On another note, this topic can't really be debated, because there are so many possibilities as to who actually WAS commanding the Legion and how many commanders it actually had, we'll never reach an answer. Maybe Bungie didn't even care, which is why it was never mentioned. It has no relevance to the story either way. Hmm?
