I'm pretty sure that wasn't to get into a debate, that was to lash out at Microsoft. The issue comes in continuing to post, and in how the first reply doesn't lend itself to mature conversation. I agree that if you don't want to get into anything you shouldn't say anything.
For your subject, piracy is piracy, but I never thought of distributing something that's free as being piracy. Maybe it fits some reasonable definition, but I think you'd be hard-pressed to find average people who would call it piracy without some added explanation. Explaining that it's not actually out yet would probably do the trick.
Come to think of it, how did these guys get the game? Did they hack into a server, or was there a leak...?
