Depends what era you're talking about, I think.
In the TFL-era, my impression is that "The Legion" wasn't formed as a single military unit- rather, it's a scratch-Legion, formed from the survivors and veterans of maybe a dozen destroyed armies. Most likely, a good number of Legionairres might have had uniforms, but in most cases, they'd probably be the (dirty, ragged) uniforms of whatever destroyed unit that particular Legionairre originally hailed from- in any case, as long as you can clearly tell that a man isn't a Thrall, the state of his uniform is probably a secondary consideration.
By the Soulblighter-era, The Legion has actually become a Regular army, with the Legionairres themselves being much more likely to be wearing proper uniforms as a result. Here, I'd say we've got one of two options: we know that, by this period, there is considered to be at least seven distinct "Legions"- it would be possible that each Legion has a different colour scheme, which would account for the varying uniforms we see (the Legion with the red-and-white surcoats simply being the one we see the most often). If this isn't the case, then red-and-white is likely to be the official Legion colourscheme overall.
