I'd give them the benefit of the doubt here if they had created all the content themselves, but they have literally stripped and stolen assets and code from a largely-unreleased (it never came out of beta in Russia did it?), Microsoft-created game to re-purpose it for their own game. This case is nothing like what the Venerance team is doing.

Microsoft has also yet to take any legal action, they just suggested the modders take everything down as far as I can tell. They seem to be encouraging that greatly though, suggesting to me that legal action will come if they don't take the hint.
