On the first level on Heroic or Legendary, you have to clear the big hill where the Kraken is seen shooting near. Since only the Elite's survival matters to the achievement, killing his minions doesn't affect it. He shoots at you and your teammates on the way up, but soon as he steps on the platform at the top he becomes an ally. I've gotten the achievement, but he got swarmed by Soldiers the moment he reached the top. :(
