I'll try to be as clear about this as I can. Community Customs is not scared of running any map or gametype. 343i does not really have any say in who gets banned, or more importantly who doesn't get banned. (I think the lack of support or acceptance for modded content is for the most part in line with rules we've had for a long time, but I'm not quite sure.) There is no argument against the statement that having modded content on your file share can get you banned. To the best of my understanding (and the understanding of several others), having this content at all is a ban-worthy offense as far as Microsoft is concerned-- specifically, this is because of the Terms of Service for Xbox Live, which are out of our control and not negotiable. We do not want to be responsible in any way, shape, or form for someone getting banned. We don't like this either, but it is how it is. We're all pretty solid in our stance on this.
Speaking for myself, if you want to make, use, or share modded content, I don't care, I won't try tell you it's wrong or to stop you or go on and on about the risks or anything. I'm not even going to tell you that if you get banned you shouldn't come crying to me. I like that people are doing things with the game that are outside of what we were provided as part of the game proper but within the mechanics of the game, or that play with the mechanics but leave most of the dependable, constant things the same. I'm not going to participate in playing with these things partly because of the risk and partly to be less tempted to play on them more (especially with other people) or try to share them (like with a file share).
If someone who knows more about any of this than us reads this, please tell us about any misunderstandings we might have about this, we would welcome it. (It would have to be someone who works for Microsoft for us to change this policy, though.)
