IIRC, the rank of Arbiter is a traditional one that predates the Covenant, and that it was the highest rank of the Sangheili military, and that it wasn't until after Fal Chavamee, the Arbiter from the Legends story "The Duel," was labelled a heretic that the rank of Arbiter attained the meaning it had when we were first introduced to the rank in Halo 2. Perhaps after the Great Schism, the rank of Arbiter reverted to its prior role as top general of the Sangheili military.

Also, just like how we identify Mjolnir armor with the Chief, we pretty much identify the Arbiter armor with Thel Vadam.
